The Grant and Renewal of Liquor Licenses in Punjab

Introduction

In India, a liquor license is required for anyone who intends to manufacture, sell, transport, and possess alcoholic drinks. The process of applying for and renewing these licenses is governed by the respective Excise Department of the State. Therefore the process differs from state to state. In this blog we will discuss in detail about the obtaining and  renewal  process of liquor licence in the state of Punjab.

Regulations Governing the Grant of Liquor Licenses

The right to sell or supply liquor is granted to an individual or business by the Excise Department. The Punjab Excise Act and the Punjab Intoxicants License & Sale Orders govern the terms to issue and renew a license. The number of the licenses to be issued or permitted in a given area would be specified in such legislations. Some of the main provisions are that a license is issued to a person or a business house for specific premises. License may be issued to any kind of entity, such as society, company, HUF, or government department. Where a license is issued to a partnership, names of all partners are to be specified. Any changes regarding the partnership or representative of the entity require updation of the license.

Renewal of Liquor Licenses

Renewing of a liquor license is as significant as acquiring one in the first instance. The renewal process ensures that the license holder continues to meet the legal and financial obligations required for the sale of alcohol. To renew a liquor license, the holder must submit a written application to the appropriate authority, typically the Excise Officer. In case of licenses acquired through auction, the renewal application will have to be made by the eligible person or business house, and the renewal will be granted by the Collector.

One significant requirement in renewals is that renewal applications have to be submitted within the time limits. Renewal applications have to be made every year before 31st January. The Excise Officer has to make a list of all renewals due and submit them to the Collector before 10th of February. If renewal application is not filed within the stipulated dates renewal may be refused later.

Extension for Renewal of Liquor Licenses

Sometimes, license holders may apply for extension for renewal of their liquor licenses. Such applications must be made to the Excise Commissioner’s office by the end of October every year, and the request for renewal must be processed under the Punjab Intoxicants License & Sale Orders. The renewal process is subject to certain restrictions and conditions, especially when the license holder is involved in activities such as bottling or wholesale distribution of alcoholic beverages.

While many other liquor license types, such as a license for the sale of country liquor or foreign liquor, vary by application procedures and renewal times, there are some different rules that apply to licensees of distilleries and wineries. Licensees of these establishments often have to seek special permission before engaging in certain activities.

Penalties for Violations

The rules that govern liquor licenses cannot be overstated in importance. The breach of these regulations is strictly penalized.

Penalties may range from Rs. 3 Lakhs as a fine for the first offense to Rs. 10 Lakhs for the second offense. The authorities suspend the license for a fixed period for habitual offenders. Business operations of the violator are affected in such scenarios.

The rules governing the issuance and renewal of liquor licenses are intended to preserve public safety, prevent unlawful sales, and ensure that businesses operate on the right side of the law.
